Terms and Conditions of Pamporovo PLC on Provision of Ski School Services And Rental of Ski Outfits
I. APPLICABILITY OF THE TERMS AND CONDITIONS ON SERVICE PROVISION
1.1. These rules apply to clients and staff of the ski school and the ski rental depots of Pamporovo PLC. The General Terms and Conditions of service provision refer to determination and provision of the particular service connected with the ski school and ski rental depots referring to different winter sports as: alpine skiing, cross-country skiing and snowboarding.
ІІ. BASIC RULES
2.1. Clients of the ski school and the ski rental depots shall be informed in advance about the equipment necessary for the ski lessons.
2.2. Clients shall provide the staff of the ski rental depots with their physical data so that they are equiped appropriately.
2.3. Clients are liable about the condition and the efficiency of their equipment when they take part in ski lessons or ski courses.
2.4. The ski school is entitled to terminate the lessons if the staff establishes or considers that the equipment of the client is inappropriate or in unsatisfactory condition to ensure his/her safety during the ski lessons or courses.
2.5. Clients will attend the courses or the lessons of the ski school of Pamporovo PLC at their own risk.
2.6. The ski school is not obliged in any way to compensate the client or any third party in case of accidents caused intentionally or not by the client.
2.7. Pamporovo PLC guarantees that the ski and snowboard equipment, which is rented out is in good condition with correct adjustment of ski bindings.
2.8. Ski rental depots of Pamporovo PLC shall not be liable for any damages caused by factors and events beyond the control of Pamporovo PLC as a ski equipment provider.
2.9. The staff of the ski rental depots shall carry out the following activities:
2.9.1. To adjust the ski bindings according to the requirements and the specifications of the manufacturer of ski/snowboard equipment.
2.9.2. To adjust the ski/ snowboard bindings based on the personal data provided by the clients and the requirements of the manufacturer of the equipment.
2.9.3. Ski lessons on the territory of the ski zone at Pamporovo, are allowed to be conducted only by ski instructors/teachers, which have purchased the required seasonal ski lessons pass for the purpose, are part of and have a contract with a legible, registered Ski school.
ІІІ. SKI EQUIPMENT RENT AGREEMENT
3.1. The ski equipment rent agreement shall be made in writing and shall include the following information:
3.1.1. Corporate data of Pamporovo PLC as an owner of the ski rental depots.
3.1.2. Client’s full name, personal identification number, address and phone number.
3.1.3. Data about the provided equipment.
3.1.4. Data about the ski adjustments.
3.1.5. Data about height, weight and skiing skills of the clients.
3.1.6 . Rental Terms of the ski equipment.
3.1.7. Price of the provided service.
3.1.8. Signatures of the client and the authorized staff.
3.1.9. Specific clause that the client is aware of the delivery conditions.
3.2. After execution of the ski rent equipment agreement the client shall acquire personal right to use the equipment on the ski runs, which is in operation and ready to use. The client shall not provide to third parties their equipment or use it outside the ski area of Pamporovo.
ІV.LIABILITY OF THE LESSER AND THE LESSEE OF THE SKI AND SNOWBOARD EQUIPMENT
4.1. The client shall provide information about the correct adjustment of ski bindings /height, weight and skiing skills/.
4.2. The client is responsible to provide true and correct information.
4.3. The client shall use the equipment appropriately in order to avoid their damage or loss.
4.4. The client shall not make changes on the adjustment of the ski bindings made in the ski rental depot. Provided that additional adjustment is necessary the client shall bring the skis for adjustment of the ski bindings at the ski rental depot of Pamporovo PLC. Any adjustment of ski bindings shall be recorded in the ski equipment rental agreement.
4.5. No signs shall be made on the equipment, as well as no parts of the equipment shall be removed or made loose.
4.6. Provided that the equipment needs any repair, the client shall bring it to the ski rental depot for carrying out the repair.
4.7. The ski rental station staff is responsible for the correct adjustment of the ski bindings made on the basis of the individual data provided by the client.
V. RESPONSIBILITY IN CASE OF DAMAGE OR LOSS OF RENTED EQUIPMENT
5.1. The client shall inform immediately the staff of the ski rental depot for any accidents involving damage or loss of the rented equipment.
5.2. The police shall be notified if the equipment is stolen.
VІ.LIABILITY OF THE LESSEE
6.1. The client shall pay compensation in case of loss or damage of the ski/ snowboard equipment.
6.1.1. In case of loss – compensation for the amount of the purchase price of the equipment.
6.1.2. In case of damage – compensation for the amount of the expenses incurred for the repair of the equipment unless the ski rental staff decides that adequate care has been taken of the equipment.
6.2. The staff of the ski rental depots of Pamporovo PLC shall inform the client about any noticed damage when the equipment is returned. The client shall pay for the damage depending on its type in the manner specified below.
6.3. For damages that may be remedied according to the price list of the ski repair shop of the ski rental depot of Pamporovo PLC.
6.4. The current value of the lost equipment or payment of that part of the equipment, which may not be remedied.
6.5. The client will not pay any compensation for the normal wear and tear of the equipment.
VІІ. PAYMENT FOR THE SERVICE
7.1. Upon on-site rent of the equipment – the service shall be paid at the time of signing the agreement and requesting the service.
7.2. In case of preliminary on-line booking payment shall be made upon filling in the booking form.
7.3. In case of preliminary booking made via a tour operator – payment shall be made under the conditions of the contract with the tour operator for ski services delivery.
VІІІ. RETURN OF EQUIPMENT
8.1. Equipment shall be returned every day regardless of the number of rented days unless the agreement provides otherwise.
8.2. If the client wishes to extend the equipment rent agreement, they shall make that prior to the expiration of the rental term.
8.3. If the client returns the equipment after expiration of the term or the client fails to return the equipment, Pamporovo PLC is entitled to request payment for the period of time in which equipment has been used based on the price determined in the price list for the shortest possible term.
ІХ. CANCELLATION, TERMITION OF THE USE OF THE RENT EQUIPMENT OR SERVICES OF SKI SCHOOL OF PAMPOROVO
9.1. Clients must arrive timely at the agreed place in the agreed time for the start of the ski lessons equipped appropriately. In case of delay or failure to attend the ski lesson the client will not receive any compensation.
9.2. Provided that the clients have booked services of the ski school and the ski rental depots of Pamporovo PLC within the agreed terms but fail to appear, the paid fee shall not be recovered.
9.3. Pamporovo PLC will not reimburse any amounts for prepaid services nevertheless due to:
9.3.1. Termination of the service as a result of trauma or disease.
9.3.2.Closing a part of or the whole ski area.
9.3.3. Any other reasons beyond the control of Pamporovo PLC acting in the capacity of an owner of the ski rental depots and a provider of the ski/snowboard rent equipment and repair services.
Х. LAYING CLAIMS
10.1 Any claims concerning the ski school or the ski rental stations of Pamporovo PLC shall be referred directly to the ski school. Claims shall be made in writing within 7 days following the clients’ departure unless there is a reasonable cause to extend the term of laying the claim.
ХІ. SCOPE OF SERVICES PROVIDED BY THE SKI SCHOOL AND THE SKI RENTAL DEPOTS
11.1 The scope of services provided within the ski area of Pamporovo includes the activities of the ski school and the ski rental depots of Pamporovo PLC and is covered by these General Terms and Conditions. All clients, the staff of the ski rental depots and the ski instructors shall strictly comply with these General Terms and Conditions.
ХІІ. DISPUTE SETTEMENT
Any disputes that may arise shall be settled by negotiations between the client and the ski school. In case of failure to come to an agreement, the client may refer the dispute to the competent Bulgarian court at the address of registration of the ski school.

2.9.The staff of the ski rentaldepotsshall carry out the following activities:

2.9.2.To adjust the ski/ snowboard bindings based on thepersonaldata provided by the clients and the requirements of the manufacturer of the equipment.
